Terms and Conditions. Effective Date: February 1, 2026. This website (jamesrobbinsfineart.com or similar) is owned and operated by James Robbins Fine Art, based in Coquitlam, British Columbia, Canada. These Terms and Conditions ("Terms") set forth the legally binding agreement between you and us governing your access to and use of our website and services, including commissioning custom artworks (e.g., portraits of loved ones, pets, or animals). By accessing, browsing, or using this website, or by commissioning artwork, you acknowledge that you have read, understood, and agree to be bound by these Terms. Website Offering: We offer custom fine art commissions, original paintings and print on demand (POD) artworks, and related services. Who Can Use Our Services: You must be at least 18 years of age (or the age of majority in your jurisdiction) and possess the legal authority to enter into binding agreements. Use is prohibited if it violates any applicable laws. Key Commercial Terms: Commissions are made-to-order. By paying a deposit or full payment, you enter a binding contract. You are responsible for reviewing descriptions, providing accurate references (e.g., photos), and approving proofs. Prices are as quoted during commissioning; we reserve the right to adjust for changes in scope. Deposits are typically 50% upfront (non-refundable after work begins). Full payment due before physical shipment after proof approval.. Taxes (e.g., GST/HST) and shipping fees apply as outlined in our Shipping Policy.
Return and Refund Policy
Custom artworks are personalized and non-refundable once work has commenced or proofs approved. Deposits are non-refundable. If unsatisfied with a proof, revisions are offered (limited per agreement). Physical items: See Shipping Policy for damage claims. We reserve the right to cancel commissions for any reason, with refund of unearned payments. Retention of Right to Change Offering: We may modify, discontinue, or limit services, prices, or features at any time without notice or liability. Warranties and Responsibility: Artworks are created with care, but slight variations from references/proofs may occur due to artistic interpretation. We warrant materials and workmanship for 1 year (repair/replacement at our discretion). No other warranties expressed or implied.
Ownership of IP/Indemnification/Limitation of Liability
Ownership of Intellectual Property: All artworks, designs, and content on this site (including images, text, and originals) are owned by James Robbins Fine Art and protected by copyright. You receive the physical or printed artwork for personal use; we retain all intellectual property rights unless a separate transfer agreement is made. Commissioned works: You grant us a license to use provided references for creation and promotion (e.g., portfolio display). User-Uploaded Content: By submitting references (photos, descriptions), you confirm you own or have rights to them and grant us permission to use for the commission and site promotion. You agree not to submit infringing or unlawful material. Right to Suspend or Cancel: We may terminate or suspend access/services if you breach these Terms, with no liability. Indemnification: You agree to indemnify and hold James Robbins Fine Art harmless from any claims, losses, or expenses arising from your use of the site, submitted content, or breach of Terms. Limitation of Liability: To the maximum extent permitted by law (including British Columbia consumer laws), we are not liable for indirect, consequential, or incidental damages, including loss of data/profits. Total liability limited to amounts paid for the commission. Right to Change Terms: We may update these Terms at any time; changes posted here. Continued use constitutes acceptance. Promotional Emails: You consent to occasional promotional emails; opt out anytime by replying or contacting us. Governing Law and Disputes: These Terms are governed by the laws of British Columbia, Canada. Disputes resolved exclusively in courts of Coquitlam/Vancouver, BC.
